These Terms and Conditions ("Terms") govern your participation in Gather ("the Programme"), operated by Sammie Fleming ("we", "us", "our").
By enrolling in Gather, you acknowledge that you have read, understood and agree to be bound by these Terms.
Gather is a twelve (12) month coaching and personal development programme delivered through educational content, group coaching calls, recordings, resources and community engagement.
Your enrolment provides access to the Programme for the duration of the twelve-month programme period.
By enrolling in Gather, you are making a commitment to participate in the full twelve-month Programme.
Enrolment in Gather constitutes acceptance of these Terms and creates a binding agreement between you and Sammie Fleming.
Participants who elect to pay by instalments remain responsible for the full Programme fee and are not entering into a month-to-month subscription arrangement.
The current investment for Gather is AUD $147 per month, unless otherwise stated at the time of enrolment.
Participants may choose either:
Payment in full; or
Monthly instalments.
Where a monthly instalment option is selected, you acknowledge and agree that:
You are committing to the full twelve-month Programme.
The instalment plan is offered as a payment convenience only and does not constitute a month-to-month membership or subscription.
Your enrolment represents a commitment to the full Programme fee.
You remain responsible for payment of the full Programme fee regardless of your level of participation.
Failure to attend calls, access materials, engage in the community, or complete the Programme does not release you from your financial commitment.
If you choose to discontinue participation in Gather before the Programme concludes, all remaining instalments remain due and payable.
We reserve the right to suspend access to Programme materials, recordings, live calls and the community if payments become overdue.
Any outstanding amounts owing under your Programme commitment remain payable and may be recovered through reasonable collection processes where necessary.
You are responsible for ensuring that your payment details remain current and valid.
If a payment is declined, fails, is disputed, or cannot be processed:
Access to Programme materials, recordings and the community may be suspended until payment is received.
We reserve the right to pursue recovery of any outstanding amounts.
Any unpaid balance relating to your Programme commitment remains payable.
All enrolments in Gather are final.
Subject to any rights that cannot be excluded under applicable law, no refunds, credits, transfers or exchanges are available.
This includes situations where:
You change your mind.
You decide the Programme is no longer suitable for you.
You fail to attend live calls.
You fail to access Programme materials.
Personal, professional, financial or health circumstances change.
You choose to withdraw from the Programme.
If you elect to discontinue participation before the end of the Programme, all remaining payments under your twelve-month commitment remain due and payable.
Gather includes live coaching sessions and other live events.
Live sessions may be recorded.
By participating in live sessions, you consent to being recorded and to those recordings being made available to other participants within Gather.
Recordings will generally be available for the duration of the Programme.
While we intend to provide recordings where possible, we do not guarantee that every session will be successfully recorded or remain available indefinitely.
No refunds, credits or compensation will be provided for missed live sessions.
Participants may be provided access to a private community hosted on Podia.
You agree to engage respectfully and professionally with all participants.
We reserve the right to remove any participant from the Programme or community, without refund, if we reasonably determine that their behaviour:
Is abusive, threatening, discriminatory or harassing;
Disrupts the learning environment;
Breaches confidentiality;
Causes harm to other participants;
Damages the integrity of the Programme or community.
Removal from the Programme does not release you from any outstanding payment obligations.
Gather is intended to provide a supportive environment for personal growth and development.
Participants agree to treat information shared by other members as confidential and not disclose, reproduce, distribute or share another participant's personal information, stories, experiences or materials outside the Programme without their express permission.
This obligation continues after your participation in Gather ends.
All Programme materials, content, resources, recordings, worksheets, teachings, frameworks, methodologies and related materials remain the intellectual property of Sammie Fleming unless otherwise stated.
Your enrolment grants you a limited, non-exclusive, non-transferable licence to access and use the materials for your personal use only.
You may not:
Reproduce Programme materials;
Share Programme materials with others;
Upload Programme materials to third-party platforms;
Teach, license, distribute, sell or commercially exploit Programme materials;
Allow another person to access the Programme using your account.
Unauthorised use of Programme content may result in immediate termination of access and legal action where appropriate.
Access to Gather is provided solely to the enrolled participant.
Login details must not be shared with any other person.
We reserve the right to suspend or terminate access where account sharing is suspected.
Gather is a coaching, education and personal development programme.
The Programme is not therapy, counselling, psychological treatment, medical advice, legal advice, financial advice, or any other regulated professional service.
No information provided within Gather should be relied upon as a substitute for professional advice from a qualified practitioner.
You remain solely responsible for:
Your decisions;
Your actions;
Your wellbeing;
Your personal, professional and financial outcomes.
Individual results will vary and no guarantees are made regarding specific outcomes, achievements or results.
Gather is designed to support personal growth, reflection, learning and implementation. Your experience and results will depend on a variety of factors, including your level of engagement, participation and personal circumstances.
You acknowledge that you are responsible for your own decisions, actions, wellbeing and results throughout and following the Programme.
While every effort is made to provide a valuable and supportive experience, no guarantees, warranties or representations are made regarding specific outcomes, results, achievements, income, business growth, personal transformation or other benefits arising from participation in Gather.
To the maximum extent permitted by applicable law, Sammie Fleming shall not be liable for any direct, indirect, incidental, special or consequential loss, damage or expense arising from or related to participation in Gather.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under applicable law.
You acknowledge that participation in coaching and personal development programmes involves personal responsibility and that outcomes depend on numerous factors beyond our control.
We reserve the right to make reasonable changes to the Programme structure, content, schedule, delivery method, facilitators, call times, resources or community arrangements where necessary.
Where possible, participants will be notified of significant changes.
We reserve the right to reschedule live sessions, provide substitute facilitators, deliver alternative content, or make other reasonable adjustments where circumstances require.
We shall not be liable for delays, interruptions or inability to deliver the Programme resulting from events beyond our reasonable control.
These Terms shall be governed by and interpreted in accordance with the laws of New Zealand.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
